This confirmation records that they have received the data protection information; it does not replace or encompass any specific consent that may be required for optional purposes, such as retaining a profile for future opportunities, presenting it to third parties outside a particular project or sending general marketing communications.<\/p>\n<p>Where a purpose relies on consent, consent will be requested through a clear affirmative action that is freely given, specific, informed, unambiguous and separate from other purposes. Professional and collaboration details<\/h3>\n<p>Profession, specialism, department or role; experience; education and training; CV; portfolio, video portfolio, showreel, website or professional profiles; languages; availability; permits, certifications or professional authorisations; references; rates, quotations, terms of collaboration and strictly professional internal assessments of a profile\u2019s suitability for an opportunity.<\/p>\n<h3>3.3. Supplier, rental and company details<\/h3>\n<p>Trading name, registered company name, contact person, role, professional contact details, services and resources offered, equipment, spaces, vehicles, technical specifications, coverage, availability, rates, quotations, insurance, permits, licences, certifications and, when a relationship is formalised, tax, bank and invoicing details.<\/p>\n<h3>3.4. Prospective client and project details<\/h3>\n<p>Identification and professional contact details; organisation or brand; project information; production requirements; dates, locations, scope, indicative budget, briefs, references and materials submitted to assess a proposal.<\/p>\n<h3>3.5. Talent and casting details<\/h3>\n<p>Photographs; self-tapes; videos; voice recordings; video portfolios; performance materials; age or age range; height, clothing sizes, measurements and other physical characteristics only where relevant to a particular role or project; languages, accents, skills, experience, availability, place of residence or ability to travel, and representative or agency details where applicable.<\/p>\n<p>Photographs, videos and voice recordings will not be used for facial recognition, biometric identification or to create biometric templates intended to uniquely identify a person.<\/p>\n<h3>3.6. Contractual, administrative and technical data<\/h3>\n<p>Where applicable, data needed to enter into contracts, manage payments, invoicing, insurance, production documentation, image and voice rights, intellectual property or audiovisual exploitation rights, and comply with tax, employment, commercial or accounting obligations.<\/p>\n<p>IP addresses, submission dates and times, browser, device, language, originating page or form, the route taken through a form, evidence of acknowledgement or consent, technical incidents, security logs and data needed to prevent fraud or unauthorised access may also be processed.<\/p>\n<h2>4. Sources, accuracy and updating of data<\/h2>\n<p>As a general rule, data are obtained directly from the data subject, their representative or the organisation for which they work. Data may also be obtained from talent agencies, representatives, clients, partner companies, professional references or publicly accessible professional sources where a valid legal basis exists.<\/p>\n<p>Where data are not obtained directly from the data subject, La Huella Studio will provide the information required by law, including the source of the data and the categories processed, within the applicable statutory periods, unless a legal exception applies.<\/p>\n<p>Users confirm that the data they provide are true, accurate, complete and up to date, and undertake to report any relevant changes. Professionals, freelancers and collaborators<\/h3>\n<p>Data may be processed to assess experience, specialism and availability; manage an application or proposal to collaborate; request information, quotations or availability; assemble production teams; and enter into, manage or perform a potential contract.<\/p>\n<p>Adding and retaining a profile in the general network for future opportunities will require the specific option provided for that purpose where the processing relies on consent.<\/p>\n<h3>7.2. Suppliers, rental companies and other service providers<\/h3>\n<p>Data may be processed to assess services, equipment, materials, vehicles, spaces or resources; request quotations and availability; coordinate productions; manage orders, bookings, contracts, invoicing and payments; and maintain the professional or commercial relationship.<\/p>\n<h3>7.3. Prospective clients, companies and institutions<\/h3>\n<p>Data may be processed to answer enquiries, assess requirements, prepare meetings, proposals and quotations, negotiate and manage precontractual relationships and, where applicable, plan and carry out the contracted project.<\/p>\n<h3>7.4. Talent and casting<\/h3>\n<p>Casting data and materials will be processed to register applications, assess professional or artistic suitability for a project, check availability, shortlist and select candidates, contact applicants and enter into a potential contract.<\/p>\n<p>When someone applies for a particular casting or project, La Huella Studio may disclose strictly necessary data and materials to entities involved in that project, to the extent needed to assess, shortlist or select the applicant and in accordance with the information provided in the casting call or form.<\/p>\n<p>A profile will only be retained for future opportunities and presented in limited form for future opportunities other than the original casting or project where the person has given the corresponding specific consent, or another valid legal basis applies and they have been informed of it.<\/p>\n<h3>7.5. Portal-related communications<\/h3>\n<p>La Huella Studio may contact data subjects about the status of their registration or request, the need to complete or update information, a particular application or assignment, requests for availability or quotations and, where authorised, future opportunities compatible with the selected category.<\/p>\n<p>These communications do not in themselves authorise general advertising or marketing communications unrelated to the relevant relationship, request or consent.<\/p>\n<h2>8. Mandatory data<\/h2>\n<p>Fields marked as mandatory are necessary to process the relevant request, application, quotation, registration or relationship. Refusing to provide those data will prevent the request from being handled or the affected process from being completed.<\/p>\n<p>Fields not marked as mandatory are optional. Leaving them blank will not prevent submission of the form, although the information may be needed later for a particular contract, project or legal requirement.<\/p>\n<h2>9. Recipients of data<\/h2>\n<p>La Huella Studio does not sell databases, automatically publish profiles or allow general or indiscriminate access to registered information.<\/p>\n<p>Data may be disclosed only where necessary and in accordance with the stated purposes to the following categories of recipients:<\/p>\n<h3>9.1. Entities involved in a project or opportunity<\/h3>\n<p>For a particular casting, production, engagement, proposal or project, strictly necessary data may be received by clients, agencies, advertisers, brands, production companies, co-production companies, production or post-production businesses, institutions, event organisers and people responsible for or collaborating on the project.<\/p>\n<p>Disclosure will be limited to assessment, shortlisting, selection, contracting or project delivery. Wherever possible, a limited version of the profile will initially be shared: stage or professional name, specialism, relevant experience, availability, portfolio, video portfolio, showreel or the material essential to assess suitability.<\/p>\n<p>Identity documents, bank or tax details, direct contact details and administrative documentation will not be disclosed at the initial stage unless needed to formalise a relationship and the person has been informed.<\/p>\n<h3>9.2. Providers acting on behalf of La Huella Studio<\/h3>\n<p>Providers of forms, web hosting, storage, email, document management, CRM, automation, backups, IT security, technical support, administration, advisory, accounting or invoicing services may access data where they act as data processors and the contract required by Article 28 of the GDPR is in place.<\/p>\n<h3>9.3. Independent controllers and authorities<\/h3>\n<p>Professional advisers, insurers, financial institutions, public administrations, the Spanish Tax Agency, Social Security, law enforcement bodies, courts, tribunals and other authorities may access data where necessary to provide the service, comply with a legal obligation, manage insurance, respond to a valid request or defend legitimate rights and interests. These recipients may act as independent controllers where they determine their own purposes and means of processing.<\/p>\n<h2>10. International data transfers<\/h2>\n<p>La Huella Studio may use technology providers or work with entities that process data outside the European Economic Area. Where an international transfer applies, it will take place only in accordance with Article 44 and subsequent articles of the GDPR, on the basis of a European Commission adequacy decision, standard contractual clauses, binding corporate rules or another valid legal safeguard or derogation.<\/p>\n<p>Up-to-date information on transfers associated with cookies, advertising or analytics tools will be provided in the Cookie Policy and consent manager. Retention periods<\/h2>\n<p>La Huella Studio will retain data for as long as necessary for each purpose and subsequently for the applicable statutory limitation periods. Once the main purpose has ended, data may be kept blocked, without routine use, solely to address legal, administrative, tax, employment, contractual or judicial liabilities.<\/p>\n<h3>11.1. Professional, supplier, rental and talent profiles<\/h3>\n<p>Profiles voluntarily added to the general network of professionals, suppliers, rental companies or talent will be retained for 24 months from the most recent update, interaction or confirmation of interest. Before this period expires, La Huella Studio may request an update or renewal. If no confirmation is received and there is no other lawful reason for retention, the data will be securely erased or anonymised at the end of that period.<\/p>\n<p>Withdrawing consent for future opportunities will result in the profile being removed from the general network, except for data that must be retained because of an ongoing relationship or legal obligations.<\/p>\n<h3>11.2. Specific castings and selection processes<\/h3>\n<p>Data relating to an application for a particular casting or project will be retained while the process is ongoing and for up to 12 months after it closes, to handle incidents or claims or demonstrate that the process was properly administered. If the person has separately consented to joining the general network, the 24-month period in section 11.1 will apply.<\/p>\n<p>Materials that do not need to be retained for future opportunities will be erased at the end of that period, without prejudice to their being blocked where appropriate.<\/p>\n<h3>11.3. Enquiries, quotations and projects that do not proceed to contract<\/h3>\n<p>Data relating to enquiries, proposals, requests for quotations or projects that do not proceed to contract will be retained for 24 months from the last communication, unless erasure is requested earlier or the data need to remain blocked to evidence their handling or address liabilities.<\/p>\n<h3>11.4. Contractual relationships, commercial and tax documentation<\/h3>\n<p>Data relating to contracts, assignments, invoices, payments made or received and commercial documentation will be retained throughout the relationship and, as a general rule, for six years from the last entry in the books, in accordance with applicable commercial legislation.<\/p>\n<p>Data and documents relevant for tax purposes will generally be retained for four years, without prejudice to interruptions, extensions or different periods provided for by law.<\/p>\n<p>Data necessary to establish, exercise or defend contractual claims may be retained for the general period of five years from the date on which performance of the obligation can be demanded, unless a different specific statutory period applies.<\/p>\n<p>Employment, Social Security, occupational risk prevention, insurance, production and intellectual property rights documentation will be retained for the periods specifically required by applicable legislation or, where no period is specified, for as long as necessary to address liabilities arising from the relationship.<\/p>\n<h3>11.5. Marketing communications<\/h3>\n<p>Data used for general marketing communications will be retained while consent remains valid or, where applicable, while the legal authorisation continues to apply, and until the person unsubscribes or objects. The unsubscribe request will be recorded on a suppression list for as long as strictly necessary to ensure that no further marketing communications are sent.<\/p>\n<h3>11.6. Technical and security logs<\/h3>\n<p>Technical, security and fraud prevention logs will be retained for a maximum of 12 months, unless they need to be kept longer to investigate an incident, address a claim or comply with a legal obligation.<\/p>\n<h2>12. Automated processing and profile categorisation<\/h2>\n<p>La Huella Studio may use rules, automation or supporting technology to direct users to the appropriate branch of a form, organise profiles by specialism, service, availability or category, identify matches with project requirements and facilitate internal review.<\/p>\n<p>These tools will not independently make decisions on selection, engagement, rejection or collaboration proposals that produce legal effects or significantly affect the data subject. Relevant decisions will be subject to human intervention and review.<\/p>\n<h2>13. Photographs, videos, voice and audiovisual materials<\/h2>\n<p>Materials submitted to the portal \u2014 including photographs, self-tapes, videos, voice recordings, video portfolios, showreels and portfolios \u2014 will be processed solely to create and manage the profile, assess professional or artistic suitability, handle applications, conduct selection processes and, where applicable, present the profile to entities involved in a project as set out in section 9.<\/p>\n<p>Submitting these materials and reading this Policy do not authorise La Huella Studio or third parties to publish, disseminate, commercially exploit, use for promotional purposes or incorporate the submitted materials into a production. If a person is selected, any use, recording, reproduction, distribution, communication to the public, making available or exploitation of their image, voice, performance or materials will be governed by the specific contract, authorisation or grant of rights that applies.<\/p>\n<p>Audiovisual content published by La Huella Studio on its own websites and professional profiles is used for information, promotional and portfolio purposes, in accordance with the authorisation, contractual relationship or other legal basis applicable to each project. Anyone who considers that published content affects their rights may request a review by writing to hola@lahuellastudio.com.<\/p>\n<h2>14. Minors<\/h2>\n<p>As a general rule, the portal is intended for people aged 18 or over. Minors must not submit personal data, photographs, videos or applications without the involvement of their parents, guardians or legal representatives.<\/p>\n<p>Where a casting or production expressly accepts minors, a specific procedure will be established. La Huella Studio may request the identity and contact details of a parent, guardian or legal representative and the documentation strictly necessary to verify their authority to represent the minor.<\/p>\n<p>Where processing relies on consent, a minor may give consent independently from the age of fourteen, without prejudice to cases in which the law requires the assistance of the person holding parental responsibility or guardianship for the relevant legal act or transaction. If the minor is under fourteen, consent must be given by the person holding parental responsibility or guardianship. In all cases, participation in casting, retention of the profile for future opportunities, disclosure to entities involved in the project and any authorisation concerning image, voice or rights will be requested separately where appropriate. Information will also be provided to the minor in clear terms suited to their age and maturity.<\/p>\n<h2>15. Marketing communications<\/h2>\n<p>La Huella Studio may send communications necessary to manage a request, application, engagement, assignment, quotation, registration or active profile, as well as requests for updates or availability related to that processing.<\/p>\n<p>General advertising, newsletters, promotional updates or marketing communications unrelated to the authorised relationship, request or profile will require prior consent, unless another applicable legal authorisation exists. Each marketing communication will include a simple, free way to unsubscribe.<\/p>\n<p>Data subjects may ask to stop receiving communications about future opportunities, castings or collaborations without this necessarily requiring the erasure of data that must be retained to manage an ongoing application or relationship, comply with legal obligations or address liabilities. They may also request erasure of their profile where appropriate.<\/p>\n<h2>16. Rights of data subjects<\/h2>\n<p>Data subjects may exercise the following rights:<\/p>\n<p>Access: to find out which personal data are being processed and obtain information about them.<\/p>\n<p>Rectification: to request the correction of inaccurate or incomplete data.<\/p>\n<p>Erasure: to request the deletion of data where appropriate.<\/p>\n<p>Restriction: to request restriction of processing in the circumstances provided for by law.<\/p>\n<p>Objection: to object to processing based on legitimate interests and, at any time, to processing for direct marketing purposes.<\/p>\n<p>Portability: to receive the data provided in a structured, commonly used and machine-readable format, or request their transmission to another controller where the legal requirements are met.<\/p>\n<p>Withdrawal of consent: to withdraw consent at any time without affecting the lawfulness of earlier processing.<\/p>\n<p>Not to be subject to automated individual decision-making: where the requirements laid down in the GDPR are met.<\/p>\n<p>Rights may be exercised by email to hola@lahuellastudio.com or by post to C\/ Rafi Herencia, n.\u00ba 15, 3.\u00ba C, 41008 Sevilla, Spain, stating the right you wish to exercise and providing the information necessary to identify the request.<\/p>\n<p>A copy of a national identity card or other identity document will not be required unless there are reasonable doubts about the requester\u2019s identity. In that case, only the additional information necessary will be requested, in a proportionate manner.<\/p>\n<p>Data subjects have the right to lodge a complaint with the Spanish Data Protection Agency through https:\/\/www.aepd.es, without prejudice to any other administrative or judicial remedy available to them.<\/p>\n<h2>17.
